64 Individuals Agree To Settlements In Copyright Infringement Cases

WASHINGTON - September 29, 2003 - Less than three weeks after the Recording Industry Association of America (RIAA) -- backed by a diverse group of music community leaders and organizations -- announced 261 lawsuits against individuals who illegally distribute massive amounts of copyrighted music on peer-to-peer networks, officials with the organization said that 64 settlements had been reached.

Of the 64 total settlements, 12 were pre-litigation, meaning individuals who were identified as offering significant amounts of music files and had their information subpoenaed from their service provider, but not had been sued. Additionally, the RIAA has received 838 affidavits for its "Clean Slate Program," which offers amnesty to peer-to-peer network users who voluntarily identify themselves and pledge to stop illegally sharing music on the Internet (www.musicunited.org).

"The music community's efforts have triggered a national conversation -- especially between parents and kids -- about what's legal and illegal when it comes to music on the Internet," said Cary Sherman, President of the RIAA. "In the end it will be decided not in the courtrooms, but at kitchen tables across the country. We are heartened by the response we have seen so far."

On Monday, September 8th, the RIAA, on behalf of its member companies, filed the 261 copyright infringement lawsuits against individuals who were illegally distributing, on average, more than 1,000 music files for millions of other peer-to- peer network users to copy for free.

"Americans increasingly understand our need to protect this global business and secure the jobs of those who work in it," added Sherman. "The message that downloading or distributing copyrighted music files is illegal and can have real consequences is beginning to take hold in the consciousness of families across the country. This is an essential prerequisite for fostering an environment where legitimate online music businesses can flourish."
