Claim Against Lotus Dismissed By Court

CAMBRIDGE, Mass., March 6, 1989 -- Lotus Development Corp said that all claims against the company and its founder, Mitchell D. Kapor, by SAPC Inc, have been dismissed by the U.S. District Court in Boston.

Lotus said federal judge Robert E. Keeton dismissed remaining claims against Lotus and Kapor. The claims included breach of contract, misappropriation of trade secrets and confidential information, and unjust enrichment.

In late 1988, Keeton dismissed SAPC's claim against Lotus for copyright infringement on the ground that SAPC gave up its right to sue when it sold most of its assets to Lotus in 1985.

Lotus also said SAPC's motion for an immediate appeal was denied.

Lotus said the court has scheduled a hearing for March 29 to consider further proceedings with respect to Lotus' counterclaims seeking full compensation for expenses related to the suit.
