Let's just say that someone had a copy of the Eldred [ http://eldred.cc/ ] Supreme Court transcripts, culled from the generous-yet-decidedly-proprietary [ http://www.reed-elsevier.com/ ] databanks of Lexis-Nexis [ http://www.lexisnexis.com/ ]. Could that someone then go ahead and publish the transcripts on her weblog?
