Does the recent "release" of IBM patents (see
http://www.ibm.com/ibm/licensing/patents/pledgedpatents.pdf)
go any way to resolving the IP issues surrounding Hercules?
I know that Jay feels bound not to investigate patent issues, but I
wonder if anyone with more legal training or in a different
jurisdiction has any views.

The patents are apparently not released with regard to Hercules.
Hercules is distributed under the 'Q' license, but in order for IBM's release to
be effective the open source license has to be one of the ones listed on
Opensource.org as of 1/11/05
The Q license does not appear to be listed on Opensource.org.
